Purpose
The below Terms and Conditions outline proper usage of the www.KokomoCabin.com website for its visitors and work in conjunction with the Privacy Policy, which is now incorporated into the Terms of Service (the “Terms of Service” or “Terms”). By using www.KokomoCabin.com, the Customer fully accepts the entire Terms of Service. If the Customer does not accept the Terms of Service, the Customer must immediately stop using the Services.

The Terms of Service do not address Your actual rental and use of the physical property, which is defined and governed by the Rental Agreement and House Rules.

Definitions
The Terms of Services refer to all services provided by www.KokomoCabin.com, including but not limited to receiving booking information via our booking and payment system, managing reservations and payments, responding to Customers via our reservation system, and managing content on third-party channels via our channel manager. Further:

  • The term “www.KokomoCabin.com,” “we,” “us,” or “our” refers to the owners of KokomoCabin.com.
  • The term “Customer” or “You” or “Your” refers to your use of the website and the submission of personal information while using the website.
  • The term “Content” means text, graphics, images, music, software, audio, video, information, or any other form of data.
  • The term “Customer Content” refers to Content provided by the Customer as part of using the Services, including but not limited to other information.

User Requirements
The Customer must be at least 18 years of age to be eligible to use the Services. To access and use the Services, the Customer may need to provide personal information. The Customer agrees to provide and maintain accurate, current, and complete information. The Customer acknowledges that www.KokomoCabin.com has no obligation to store, maintain or provide the Customer with a copy of any Customer Content. See our Privacy Policy for more information.

The Customer agrees to access and use the Services only for vacation rental planning and booking, not for commercial purposes. The Customer  shall not:

  • License, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit the Services in any way.
  • Use, display, mirror, or frame www.KokomoCabin.com, or any individual element of the Services, name, trademark, logo, copyrighted material or other proprietary information without our express written consent.
  • Use any robot, spider, other automatic devices, or manual process to monitor, download, copy, or keep a database copy of Content made available through the Services.
  • Send unauthorized advertising, promotional materials, email, junk mail, spam, or other forms of solicitation.

www.KokomoCabin.com is excluded from or is not responsible for, any property or property management-related issues. We may modify, replace, refuse access to, suspend, or discontinue the Services, partially or entirely, at any time and at our sole discretion.

    www.KokomoCabin.com contains links to third-party websites controlled and maintained by others. The Customer accesses such third-party websites at its own risk.

    Disclaimer
    The Services and www.KokomoCabin.com are provided on an “AS IS,” “AS AVAILABLE” basis. We are not responsible for any delays, failures, or other losses resulting from data transfer over communications networks and facilities, including the internet. The Customer acknowledges that the Services may be subject to problems inherent in using such communications facilities.

    Personal Data
    We will treat customer information as we treat our own, with the highest respect - and will not sell or rent customer information. Please refer to the Privacy Policy for details.

    Indemnity
    The Customer agrees to indemnify and hold www.KokomoCabin.com and its owners and stakeholders harmless from and against all claims, actions, proceedings, liabilities, damages, losses, expenses, and costs (including without limitation court costs and reasonable legal fees) which arise from, relate to, or are connected with the Customer’s use of the Services.

    Force Majeure
    We shall not be liable to the Customer for any breach or delay of the performance of our obligations under these Terms of Service where an event outside of our control causes such breach or delay. We will take reasonable steps to minimize the effect of the delay or breach.

    Changes to the Terms Terms of Service
    We reserve the right to change these Terms of Service at any time. The Customer’s continued use of the Services following any changes shall be deemed the Customer’s acceptance of such changes.

    Governing Law and Jurisdiction
    These Terms of Service and any dispute or claim arising out of or in connection with KokomoCabin.com are governed by law, and Customers accept the exclusive jurisdiction of the State of Wisconsin courts to rule on the same.
